Terms and Conditions

CONTRACT TERMS AND CONDITIONS

The Company” is Northern Street Services. “The Client” is the Client and any subsidiary company of The Client to whom The Company provides watchmen services under the terms of this agreement.

  • 1. SERVICE

    i) The Company shall offer personnel to provide the service in accordance with the Client's schedule and instructions.

  • ii) If no explicit instructions for a location are provided, the "minimum standards" of operations will be used.

  • iii) Safety Boots, Visibility Jacket, Safety Hat, Gloves, and Safety Glasses will be provided by NSS to all watchmen officers. If a higher grade is required, NSS can provide it at a discounted rate.

  • iv) If the hours of service are extended unintentionally, the Client is charged for any hour or part thereof that exceeds the first fifteen (15) minutes.

  • v) If The Company's service is a mobile patrol, The Client must approve it.

  • 2. WATCHMEN EVENT LOG

    The premises/site manager will have access to the Watchmen Event Log. The Client must sign them on a daily basis to confirm that everything is in order. The journal will then be countersigned by the Watchmen Officer(s) on duty.

  • 3. REQUIREMENTS ON SITE

    The Client is responsible for providing a base for the Watchmen Officer that includes basic amenities such as weather protection, lighting, heating, and restroom facilities. These will be provided by The Company at an additional expense if they are required.

  • 4. HEALTH AND SAFETY

    Any Health and Safety documents that are in effect at any site or premises where Watchmen Officers are posted will be observed and followed. If none exist, the Occupational Safety and Health Act of 2007 should be used as a guideline.

  • 5. STAFF RECRUITMENT

    The Company invests considerable sum in training its own staff to the highest standard. Consequently, where a member of staff is recruited directly by The Client either whilst the member of staff is deployed to The Client or within six (6) months of leaving the employ of NSS, a charge of RM3,500 will be payable by The Client to The Company.

  • 6. COMMUNICATION EQUIPMENT

    The Watchmen Officer(s) will have a cell phone on site, which will be used solely for "check-calls" to the Control Center and in the event of an emergency. At an additional expense, the company can provide additional communication equipment, such as a Walkie-Talkie.

  • 7. PATROL MONITORING SYSTEMS

    When necessary, The Company can provide the Client with patrol monitoring equipment (Active-Guard real-time patrol monitoring system) at reduced costs

  • 8. PAYMENT

    Unless otherwise agreed in writing, invoices are prepared one (1) week ahead of time. After that, payment must be made within fourteen (14) days of the invoice's due date. The Company reserves the right to charge interest at the current base rate on all past-due sums, as well as any additional amounts due under the agreement. From the moment the payment is due until the full amount is received, interest will be computed daily. The Company may also charge for any actual expenditures spent in collecting payment of any overdue amount.

  • 9. THE COMPANY'S LIABILITY

    Our Watchmen Officers have undergone extensive training in the detection and prevention of problems in their regions of responsibility. Our police will not allow occurrences that might be controlled by our offices to occur under any circumstances. The Company ensures that the Client's property and premises will not be lost or damaged. The Client agrees to grant Watchmen Officers the required privileges, including access to offices, in order to help prevent events from occurring. The Company cannot be held liable for any actions or omissions that are outside of our officers' control. The Company has its own internal procedures for dealing with site disputes and omissions in such circumstances, but this does not preclude The Client from seeking legal advice.

  • 10. THE CLIENT'S LIABILITY

    The Client agrees to guarantee that The Company's access to the premises is not obstructed to the best of its ability, and if such access is obstructed, The Client agrees to release The Company from their obligations under this agreement.

  • 11. TERMINATION

    This agreement can be terminated by either party giving the other a one-month written notice. Otherwise, only one of the parties has the right to immediately dissolve this agreement:

  • There is a breach of this agreement's provisions that cannot be fixed, or if such a breach is not remedied within seven (7) days after written notice demanding remediation, or

  • If the other is declared bankrupt, if a receiver is appointed, or if a liquidation or winding-up proceeding is underway.

  • 12. VARIANCE

    Any changes to The Company's schedule or service(s) must be communicated to the Head Office in writing with at least twenty-four (24) hours' notice. Otherwise, the Company maintains the right to seek reimbursement for any costs incurred as a result of the interruption.

  • 13. QUOTATIONS

    Unless otherwise stated in writing, all prices and rates given by The Company are valid for 30 days.
